Terms & Conditions

Effective July 25, 2026 Last updated July 25, 2026 Also see Privacy Policy

Short version: this site is an invitation to talk, not a contract of employment. Nothing here costs talent money. Real engagements — hiring a professional, or joining as one — are governed by a separate signed agreement, and that agreement wins if it ever disagrees with this page.

01Agreeing to these terms

These terms are an agreement between you and [Legal entity name, S.A. de C.V.], operating as Matching Unicorns ("we", "us"), with registered address at [registered address].

By browsing this website, sending us a message or applying to the network, you're agreeing to these terms and to our Privacy Policy. If you don't agree with them, please don't use the site.

02What we do — and what we're not

Matching Unicorns connects professionals based in México with companies in the United States looking to hire remotely. We evaluate talent, introduce a small number of candidates per role, act as the employer of record in México, and support both sides after the hire.

To be precise about what this site is not:

  • It's not a job board. There's no public listing you apply to blindly.
  • It's not a freelancing marketplace. We don't sell hours or run projects.
  • It's not an offer of employment. Nothing on this website — including salary ranges, timelines or example profiles — constitutes an offer, a guarantee or a binding commitment.

Any figures shown on this website (retention rates, salary multiples, response times) are indicative of our experience, not promises about your specific outcome.

03Who can use this

You must be at least 18 years old and legally able to enter into a contract. If you're using the site for a company, you confirm you're authorized to act on its behalf.

04Terms for talent

It's free — always

We never charge talent. Not to apply, not to be assessed, not to be matched, not to stay in the network. If anyone ever asks you for money in our name, that's fraud — please tell us immediately.

What we ask of you

  • Accuracy. Everything you tell us about your experience, skills and availability should be true. Misrepresentation is grounds for removal from the network — and if it surfaces after a placement, it can end that placement.
  • Ownership. Only share portfolio work you're allowed to share. Don't send us anything covered by someone else's confidentiality agreement.
  • Consent for referees. Get permission before listing someone as a reference.

What we don't promise

Joining the network doesn't guarantee a match, an interview or an offer. Fewer than 6% of applicants join, and even inside the network, matches depend on real openings and real fit. We commit to honest feedback — not to a specific outcome.

Your choice, every time

We won't present your profile to a company without your approval for that specific company. You can decline any opportunity, at any stage, without any effect on your standing with us.

05Terms for companies

A separate agreement governs the work

Engaging us means signing a service agreement that sets out fees, notice periods, replacement terms and confidentiality. This website doesn't replace it, and where the two differ, the signed agreement prevails.

What we ask of you

  • Treat candidate information as confidential. Profiles we share are for evaluating that specific role — not for your general database, and not to pass to other companies.
  • No circumvention. Hiring a professional we introduced to you, outside of our agreement and within its stated period, still triggers the agreed fees.
  • Lawful, fair treatment. You'll comply with applicable employment and anti-discrimination law, and treat the professional as a full member of your team.

Re-matching

If a match doesn't work out under the conditions described in your service agreement, we'll re-match you at no additional placement cost. The specifics — timing, scope, exclusions — live in that agreement.

06The employment relationship

Where we act as employer of record, the professional is formally employed by us in México under Mexican labor law, works exclusively for the client company, and is paid through us. We handle payroll, statutory benefits, taxes and compliance.

This structure doesn't make us the client company's employer, agent or partner, and it doesn't make the professional an employee of the client company under Mexican law. Each relationship is set out in its own written agreement.

07Acceptable use

Please don't:

  • Submit false, misleading or someone else's information.
  • Scrape, crawl or bulk-extract content from this site.
  • Try to break, overload or gain unauthorized access to the site or our systems.
  • Use the site to send unsolicited commercial messages.
  • Impersonate anyone, or misrepresent your relationship with a company.
  • Use our brand, illustrations or content to suggest an endorsement we haven't given.

08Intellectual property

The Matching Unicorns name, logo, unicorn mark, illustrations, written content and the design of this website belong to us or are used with permission. You may not copy, adapt or republish them without written consent.

The Quicksand typeface is used under the SIL Open Font License.

What you send us stays yours. Your résumé, portfolio and videos remain your intellectual property. You grant us only the permission we need to evaluate you, present you to companies you approve, and support you afterward.

09Disclaimers

This website is provided "as is". We work to keep it accurate and available, but we don't warrant that it will be uninterrupted, error-free, or that any content is complete or current.

We're not responsible for the conduct of any company or professional in the network. We vet carefully and we stay involved — but we're not a guarantor of anyone's performance, and we don't control decisions made inside a client company.

Links to third-party websites are for convenience only; we don't control or endorse their content or practices.

10Limitation of liability

To the fullest extent permitted by law, we won't be liable for indirect, incidental, special or consequential damages, or for lost profits, lost opportunities or lost data, arising from your use of this website.

Where liability can't be excluded, our total liability relating to this website is limited to [cap amount — e.g. fees paid in the preceding 3 months, or a fixed sum]. Liability arising from a signed service or employment agreement is governed by that agreement's own terms.

Nothing here limits liability for fraud, gross negligence, or anything else that can't lawfully be limited.

11Indemnity

You agree to hold us harmless from claims and reasonable costs arising from information you submit that turns out to be false or infringing, your breach of these terms, or your unlawful use of the site.

12Ending the relationship

You can leave the network whenever you want — email us and we'll remove your profile, subject to records we're legally required to keep (see the Privacy Policy).

We may remove someone from the network for misrepresentation, breach of these terms, or conduct that puts other people in the network at risk. Where it's fair to do so, we'll explain why.

Active placements are wound down according to the applicable employment and service agreements, never abruptly.

13Governing law

These terms are governed by the laws of [México / specific state — confirm with counsel]. Any dispute will be resolved by the competent courts of [jurisdiction and venue], unless a signed agreement between us specifies otherwise.

If any provision is found unenforceable, the rest stays in effect.

14Changes to these terms

We may update these terms as the business evolves. The "last updated" date at the top always reflects the current version, and for material changes we'll notify the network directly rather than relying on you to re-read this page.

15Contact us

Questions about these terms go to hello@matchingunicorns.com or through our contact form. A human replies — usually within 48 hours.
